Canon Australia Spin the Wheel Competition Perth 2024

TERMS AND CONDITIONS

1. Participation in this Canon Australia 'Spin the Wheel Perth’ Competition 2024 (Competition) is deemed acceptance of these Terms. Information and instructions on how to participate form part of these Terms.

2. This Competition starts at 11:00am AWST on 23/08/2024 and ends the earlier of 5:30pm AWST on 23/08/2024 or when all Prizes have been claimed (Competition Period).

3. This Competition requires individuals to complete an online registration form and spin the wheel located in the Ted’s Cameras Perth store at 33 King Street, Perth, 6000 (In-store Location), to win a Prize.

Eligibility
4. This Competition is only open to individual Australian residents who are not employees (or immediate family members of employees) of the Promoter or its related companies (Participants).

5. Participants under the age of 18 must have the written consent of their parent or legal guardian to enter this Competition.

How to Enter
6. On 23/08/2024, the Promoter will announce the Competition through:

a) Canon Australia Facebook, Instagram and TikTok channels;
b) www.canon.com.au;
c) Ted’s Cameras Facebook, Instagram and TikTok channels
d) https://www.teds.com.au/academy/events; and
e) at the In-store Location.

(referred to collectively as Announcements)

7. To enter this Competition (Entry), Participants must, during the Competition Period, go to the In-store Location, scan the QR code displayed, complete and submit the online registration form, and spin the wheel.

Only one Entry per Participant is permitted, and all Entries must be received by the Promotor within the Competition Period.

8. By submitting an Entry, Participants consent to receiving communications and information from Promoter. Participants will be able to unsubscribe from these communications at any time.

Judging
9. This Competition is a game of chance. Each Participant will receive a Prize for their Entry. The Participant’s Prize will be determined by spinning the wheel.

10. No responsibility is accepted for any Entry that is late, lost or misdirected, or if a Participant does not claim their Prize in accordance with these terms.

Prize
11. Each Participant will receive the Prize determined by their spinning of the wheel. The total Prize pool is $4945 including GST and is comprised of the following possible Prizes:

a) $50 Ted’s Camera Coupon (spend $200 and get $50 off) & Canon SD Card Holder (valued at $61) (Coupon)
b) Artwork by Kentaro Yoshida (valued at $95)
c) R5 Mark II limited edition drink bottle (valued at $19)
d) R5 Mark II limited edition cool bag (valued at $34)
e) R5 Mark II limited edition beanie (valued at $30)

12. For clarity, Participants may only win one (1) Prize each.

13. Promoter has the right to replace the Prize with another item of similar value in their absolute discretion if for any reason the Prize or any part of the Prize is not available.

14. Once a Prize has been exhausted, it will be removed from the wheel. If the Participant spins the wheel and lands on an exhausted Prize, they will have the opportunity to spin the wheel again, until they claim an available Prize.

Claiming the Prize
15. The Participant will be able to collect their prize immediately from the In-store Location after submitting their Entry, which includes spinning the wheel.

16. The Participant must provide proof of their Entry in order to claim the Prize.

17. If the Participant:

a. does not claim their Prize according to the instructions specified in Clause 15 and 16 ; or
b. cannot provide suitable proof as to their eligibility or compliance with these Terms, they will forfeit the Prize in its entirety.

18. The Prize or any unused portion of a Prize is not exchangeable for cash, is not transferrable and cannot be exchanged for another Prize. The Promoter will not compensate the Participant in any way for a Prize that has not been claimed within the time limits and in accordance with the instructions given to the Participant.

19. The Coupon will be valid until the 31st of August 2024. After this period, the Coupon will no longer be valid. Participants have no right to receive a refund for any unused value remaining after the expiry date. This Coupon is not eligible to be used with any other offer. 20. The Participant’s name will be published on the Promotor’s website: https://www.canon.com.au/terms-and-conditions/spin-and-win-competition-winners by 5pm AEST on 27/08/2024. It will be published for 30 days.

Participant’s Warranties and Indemnity
21. Each Participant agrees to indemnify the Promoter against all costs and claims in connection with a failure by them to comply with these Terms.

22. Each Participant agrees that they are fully responsible for each Entry they submit, and is fully responsible for any equipment, materials, licences, or other costs required for or associated with each such Entry. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.

23. This Competition is in no way endorsed, sponsored or affiliated with Instagram, Facebook, TikTok, or Google. Each Participant agrees to indemnify Instagram, Facebook, TikTok, or Google against all costs and claims arising in connection with a failure by them to comply with these Terms, or otherwise arising in connection with this Competition.

24. By accepting these Terms, the Participants confirm they have reviewed and accepted the policies, terms and conditions of Instagram, Facebook, TikTok, and Google.

Conditions that may Invalidate Entries, Participants or the Competition
25. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.

26. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:

a. to disqualify any Participant; or
b. modify, suspend, terminate, or cancel the Competition as appropriate.

27. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.

28. Errors and omissions may be accepted at the Promoter's discretion, failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Privacy
29. The Promoter collects personal information in order to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.

30. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.com.au/Privacy-Policy).

Copyright
In addition to any rights that may be granted to Participants in accordance with Instagram’s terms and conditions, by submitting an Entry, Participants grant the Promoter permission to re-post any of their Entries (including Instagram username/handle) on Instagram, Facebook and/or TikTok. The Promoter agrees to attribute the Participants by their Instagram username.

Liability
31. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms; (e) any tax liability incurred by a Participant; or (f) use of the Prize.

General
33. These Terms may change, and the Promoter will inform Participants of any changes as soon as reasonably possible.

34. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.

35. All money amounts in these Terms are in Australian Dollars inclusive of GST.

36. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.

37. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
