Canon Australia Competition – Red Bull VIP Experience

Terms and Conditions (Terms)

1. Participation in this Canon Australia – Red Bull VIP Experience promotion (Promotion) is deemed acceptance of these Terms. Information and instructions on how to participate form part of these Terms.

2. This Competition starts at 9.00 am (AEST) on 26 September 2024 and closes at 5.00 pm (AEST) on 24 October 2024 (Competition Period).

Eligibility
3. This Competition is only open to Australian residents who are not employees, or immediate family members of employees, of the Promoter or its related companies (Participants).

4. Participants must be 18 years and over to enter this Competition and to agree to these Terms.

5. To be eligible for Entry (as described in clause 9), Participants must purchase a new (not pre-owned) Eligible Product (as described in clause 8) during the Competition Period from an authorised Canon Australia retailer in the Canon Australia distribution channel (Eligible Purchase).

6. See www.canon.com.au/vip-experience to find Authorised Canon Australia retailers. If in doubt, or if a particular retailer is not included in this list, please contact the Promoter first to confirm whether the retailer is an authorised Canon Australia reseller.

7. Canon-branded products purchased from any source other than Canon Australia’s official distribution channel (including‘ grey’, ‘parallel’ or ‘direct’ imports) are not Canon Australia products and are ineligible for this Promotion.

Eligible Purchase
8. An Eligible Purchase must be made from an Authorised Canon Australia retailer, and includes:

a) Any Canon camera or lens purchased from 9:00am on 26 September 2024 until 5:00pm on 24 October 2024, or;
b) A complete purchase or partial pre-order payment of the Canon EOS R5 Mark II or Canon EOS R1 made on or before 5pm 24 October 2024.

How to Enter
9. To enter this Competition, Participants must make an Eligible Purchase and complete the entry form at www.canon.com.au/vip-experience by 5:00pm on 24 October 2024 (Entry)

10. Participants must:
A) Upload their product receipt;
B) Submit an answer to this question: Tell us in 25 words or less why you want to win; and
C) Input their details including their full name, phone number, valid email address, and state.

11. With each different product purchased (even on a single receipt), a new entry is permitted per person. All Entries must be received by the Promoter by no later than 5.00 pm (AEST) on 24 October 2024.

Judging
12. This Competition is a game of skill and the winner will be selected by the Promoter based on creativity of the answer to the question: Tell us in 25 words or less why you want to win (Winner).

13. The judges’ decision is final and no correspondence will be entered into.

14. The Promoter is not responsible for any Entry that is late, lost or misdirected, or if the Winner does not claim the Prize in accordance with these Terms.

15. The Winner and their companion must be available to travel on the following dates:

(a) Subject to clause 18 (c), to Sydney, NSW from the closest airport that supports return flights to and from Sydney to the Winner’s location in Australia on 8 November 2024; and (b) from Sydney Kingsford Smith Airport (Mascot) on 11 November 2024 to their return airport, on the flights and at the times nominated by the Promoter. If the Winner cannot travel on the above dates, they will forfeit the Prize. The Winner may choose to travel without a companion. If the Winner’s companion changes from when the Promoter books the flight, the Winner is responsible for the cost of the change in passenger details.

16. However, the Winner acknowledges that due to the nature of the Prize, dates may change for reasons outside the reasonable control of the Promoter. In such case, the Winner (and their companion) must be available on any substitute dates provided by the Promoter or its contractors. If the Winner is not available on any substitute dates provided by the Promoter, they will forfeit the Prize. The Promoter reserves the right in such circumstances to draw a new Winner.

17. If the Winner, after accepting the Prize, cannot redeem the Prize, must notify the Promoter at least seven (7) days before 8 November 2024. In these circumstances, the Winner understands they forfeit the Prize, and the Promoter reserves the right to draw a new Winner.

Prize
18. The Winner will be entitled to the following prize (capped at a maximum aggregate value up to $10,000) (Prize):

(a) Subject to clause 26, the opportunity to access an exclusive vantage point – the 27m Red Bull Cliff Diving World Final platform, which is only accessible via stairs. This experience will be run on 9 November 2024 at the Red Bull Cliff Diving World Final during an allocated time slot as specified by the Promoter;
(b) 3 nights’ accommodation at Rydges Hotel in North Sydney (for 2 people based on twin-sharing accommodation), (capped at a value of $1500);
(c) Return economy flights for two if the Winner is located outside of a 4-hour drive from Sydney CBD, excluding airport transfers. There is no substitute to this component of the prize;
(d) If the Winner is within a 4-hour drive from Sydney CBD, the Promoter may exercise their discretion in providing a NSW Transport Opal Card to a maximum value of $100.
(e) Good Food Restaurant Gift Card restaurant voucher for $500 for the Winner
(f) An Uber voucher for $100 for the Winner;
(g) VIP access to the Canon area at the Red Bull Cliff Diving World Final
(h) Opportunity to meet Canon Ambassadors in the Canon area at the Red Bull Cliff Diving World Final
(i) Limited edition Red Bull and Canon branded merchandise (capped at a value of $500)

19. The Promoter reserves the right to replace any part of the Prize with another item of similar value in their absolute discretion.

20. The Winner and their companion are solely responsible (at their own cost) for arranging all valid travel documents in order to claim the Prize (including passports and visas as required) and travel insurance cover for the Prize.

Claiming the Prize
21. The Winner will be contacted by 5:00 pm (AEST) on 25 October 2024 by a phone call to the phone number provided in their entry form. The Winner may be required to provide personal information (such as a home address or email address) in order to claim the Prize.

22. The Winner’s name will be publicly announced on Canon Australia’ Instagram channel and its website by 5.00 pm (AEST) on 1 November 2024 for period of 14 days.

23. The Winner must claim the prize within 48 hours of being contacted, in accordance with the instructions specified during the phone call.

24. If the Winner does not claim the Prize by the time and in accordance with the instructions specified during the phone call, or if the Winner cannot be contacted, or cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the prize in its entirety and an alternate winner will be chosen at the Promoter’s discretion.

25. The Prize, or any unused portion of a Prize is not exchangeable or transferrable. The Prize is not redeemable for cash or credit.

26. The 27m Red Bull Cliff Diving World Final’s platform is only accessible via stairs. There will be no lift access from the top or bottom of the platform. The Winner and their companion must be able to climb to the top of the platform and back down with no assistance. The Winner and their companion must undertake their own assessment of their ability to do so. The Promoter makes no guarantee or warranty as to the Winner and their companion’s ability to participate in the activities described in clause 18(a). If the Winner or their companion is incapable or unable to climb up and down the stairs of the platform for any reason, including but not limited to a visible or invisible disability, will be precluded from redeeming the Prize component described in clause 18 (a), but will not prevent them from redeeming the other Prize components described under clause 18 (b) - (i). The Winner and their companion must disclose, at the time of redeeming the Prize, if they suffer from any condition that impairs or prevents them from participating in in the activities described in clause 18 (a). Nothing in these Terms and Conditions compels the Winner and their companion to undertake the activities described in clause 18 (a).

27. The Promoter reserves the right to disqualify a Winner from claiming the Prize if the Promoter determines, in its absolute discretion, that the Winner is not in a condition to safely participate in the Prize.

Participant’s Warranties and Indemnity
28. Each Participant warrants to the Promoter that:

(a) their submissions are their own original creations and they have not infringed on any copyright or privacy laws;
(b) they have complied with these Terms;
(c) no Entry submitted by them will contain viruses or cause injury or harm to any person or entity; and
(d) they have and will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

29. Each Participant indemnifies the Promoter against all costs and claims in connection with a failure by them to comply with these Terms.

Conditions that may Invalidate Entries or Participants
30. The Promoter reserves the right to reject, disqualify, remove or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.

31. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Participant; or (b) to modify, suspend, terminate or cancel this Competition, as appropriate.

32. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of this Competition or to be acting in violation of these Terms.

33. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Collection of Personal Information
34. The Promoter collects personal information and email addresses in connection with the Promotion in order to conduct and promote the Promotion, including via emails and online, to entrants. The Promoter may also disclose such personal information to third party service providers, including relevant airlines and accommodation services, marketing and creative agencies, and technology providers, for these purposes, and all entrants consent to such uses and disclosures. Participation in this Competition is conditional on providing such personal information.

35. By entering this Competition, each Participant grants the Promoter the right to publish their name in its website and social media channels, and agrees to be photographed and interviewed by the Promoter should they win a Prize. The Promoter may use the Winner’s name, photograph and interview on marketing and publicity materials, including, without limitation, on its website and social media pages.

36. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.com.au/Privacy-Policy).

Liability
37. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms; (e) any tax liability incurred by a Participant; (f) any condition that affects or limits the Winner or their companion’s ability to use any component of the Prize; or (g) use of the Prize.

39. The Promoter uses a commercially reasonable level of skill and care in running the Promotion. However, as with any digital service, the Promoter cannot guarantee that its website will be live or error free all the time.

General
40. These Terms may change and the Promoter will inform Participants of any changes as soon as reasonably possible.

41. All money amounts in these Terms are in Australian dollars inclusive of GST, unless otherwise specified in these Terms.

42. The Promoter may accept errors and omissions at its discretion and its failure to enforce any of its rights is not a waiver of those rights.

43. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.

44. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
