Canon Australia Creator Event Competition 2023

Terms and Conditions (Terms)

1. Participation in this Canon Australia Creator Event Competition 2023 (Competition) is deemed acceptance of these Terms. Information and instructions on how to participate form part of these Terms.

2. This Competition starts at 6:30 pm AEST 08 June 2023 and ends at 11:59 pm AEST on 09 June 2023 (Competition Period).

Eligibility
3. This Competition is only open to individual Australian residents who are not employees (or immediate family members of employees) of the Promoter or its related companies (Participants).

4. Participants under the age of 16 must have the written consent of their parent or legal guardian to enter this Competition.

How to Enter
5. Canon is hosting the following events in Sydney, Melbourne and Brisbane:

a. Sydney Canon Creator Event at 6.30pm AEST on 18 May 2023;
b. Melbourne Canon Creator Event at 6.30pm AEST on 1 June 2023;
c. Brisbane Canon Creator Event at 6:30pm AEST on 8 June 2023;
(each event being a Canon Creator Event).

6. Participants must have received an invitation from the Promoter to a Canon Creator Event and attended the event.

7. The Promoter will announce this Competition during each Canon Creator Event and request photo and video submissions from Participants.

8. To enter this Competition (Entry), Participants must:

a. follow the instructions provided by the Promoter during the relevant Canon Creator Event to use the equipment provided and take images and/or videos of the specified areas during the timeframe provided;
b. share their most creative images and/or videos from the relevant Canon Creator Event via an Instagram post or TikTok post within 24 hours of the relevant Canon Creator Event;
c. use the hashtag #CreateWithCanonAU; and
d. tag and follow @canonaustralia and @digidirect on Instagram.

9. In addition to the above requirements, in order to be in the running to win the Powershot V10 prizes described in clause 18, Entries must be submitted in teams (of up to 6 Participants) that will be randomly assigned by the Promoter during each Canon Creator Event (Powershot V10 Team).

Moderation
10. Entries are subject to moderation. The Promoter reserves the right (in its sole discretion) to take down and exclude from judging any Entry which the Promoter considers breaches Canon Australia’s Community Guidelines.

Judging
11. This Competition is a game of skill, and the Promoter will award the prizes described in clause 15 to 2 Participants and 1 Powershot V10 Team who have posted Entries with the best creative concept and technical execution, as determined by the Promoter in their sole discretion (Winners).

12. The judges’ decision is final, and no correspondence will be entered into.

13. No responsibility is accepted for any Entry that is late, lost or misdirected, or if a Winner does not claim their Prize in accordance with these terms.

14. The Promoter reserves the right to reject any Entries generated using artificial intelligence processing tools.

15. The 1ˢᵗ prize Winners will receive the following prizes:
a. Sydney Canon Creator Event:

b. Brisbane and Melbourne Canon Creator Events:

16. The 2ⁿᵈ prize Winners for each Canon Creator Event will receive one Canon G7 X Mark II valued at $1,129 RRP.

17. In addition to the 1ˢᵗ and 2ⁿᵈ prize Winners, one Powershot V10 Team will be selected from all Entries received for each Canon Creator Event which were taken using the new Canon Powershot V10 in the location specified by the Promoter during each Canon Creator Event. Each Participant in the winning Powershot V10 Team will receive one Canon Powershot 10.

18. Canon Australia has the right to replace any Prize with another item of similar value in their absolute discretion if for any reason any part of the Prize is not available.

Claiming the Prize
19. The Winners of the Prizes will be announced on the Instagram Account as follows:

a. at 7:00 pm AEST on 22 May 2023 for the Sydney Canon Creator Event; and
b. at 7:00 pm AEST on 5 June 2023 for the Melbourne Canon Creator Event; and
c. at 7:00 pm AEST on 13 June 2023 for the Brisbane Canon Creator Event.

20. The Winners will also be notified by private message from the Promoter to the Instagram account or TikTok account that they used to submit their Entry, and they must follow the instructions in the private message to claim their Prizes.

21. If the Winner:

a. does not claim their Prize according to the instructions specified in the Promoter’s private message (including by not providing a correct address for the Prize to be delivered to by the stated due date); or
b. cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Prize in its entirety and the Promoter will choose an alternate winner from the rest of the Entries at their sole discretion.

22. The Prize or any unused portion of a Prize is not exchangeable for cash or goods and is not transferrable. The Promoter will not compensate the Winner in any way for a Prize that has not been claimed within the time limits and in accordance with the instructions given to the Winner.

23. The Winners are responsible for their own costs of attending the Canon Creator Events.

Participant’s Warranties and Indemnity
24. Each Participant warrants to the Promoter that:

a. their Entries contain their own original content and do not infringe on any copyright or privacy laws;
b. they have complied with these Terms;
c. no Entry submitted by them will contain viruses or cause injury or harm to any person or entity; and
d. they have and will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

25. Each Participant agrees to indemnify the Promoter against all costs and claims in connection with a failure by them to comply with these Terms.

26. Each Participant agrees that they are fully responsible for each Entry they submit, and is fully responsible for any equipment, materials, licences, or other costs required for or associated with each such Entry. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.

27. This Competition is in no way endorsed, sponsored or affiliated with Instagram. Each Participant agrees to indemnify Instagram against all costs and claims arising in connection with a failure by them to comply with these Terms, or otherwise arising in connection with this Competition.

28. By accepting these Terms, the Participants confirm that they have reviewed and accepted Instagram’s policies, terms and conditions.

Conditions that may Invalidate Entries, Participants or the Competition
29. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.

30. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:

a. to disqualify any Participant; or
b. modify, suspend, terminate or cancel the Competition as appropriate.

31. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.

32. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Privacy
33. The Promoter collects personal information in order to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.

34. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.com.au/Privacy-Policy).

Copyright
35. In addition to any rights that may be granted by an Entrant in accordance with Instagram’s terms and conditions, by submitting an Entry, Participants grant the Promoter permission to re-post any of their Entries (including Instagram username/handle) on Instagram, Facebook and/or TikTok. The Promoter agrees to attribute the Participants by their Instagram username.

Liability
36. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

37. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms; (e) any tax liability incurred by a Participant; or (f) use of the Prize.

General
38. These Terms may change, and the Promoter will inform Participants of any changes as soon as reasonably possible.

39. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.

40. All money amounts in these Terms are in Australian Dollars inclusive of GST.

42. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.

43. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
