The Good Guys Canon Advantages Chance to Win Program 2024

TERMS AND CONDITIONS (Terms)

1. These terms and conditions govern the participation in this Canon Advantages Chance to Win Program (Competition) Information and instructions on how to participate form part of these Terms.

2. Participation in the Competition is deemed acceptance of these Terms.

3. This Competition starts at 9:00am AEST on 01/07/2024 and ends at 5:00pm AEST on 30/11/2024 (Competition Period). 4. This Competition requires Participants to sign up to the ‘Canon Advantage product training module’ and complete one training module (Training Plan) by the last day of the Competition Period.

Eligibility
5. This Competition is only open to individual Australian residents who are:
a. The Good Guys’ employees and contractors (Participants) engaged in a sales role, customer service role or retail management role for The Good Guys (Retail Partner).
b. Participants who are under the age of 18 must have the written consent of their parent or legal guardian to enter this Competition.
c. To be eligible to enter (as described in clause 8), Participants must sign up to the ‘Canon Advantage product training program’ and successfully complete at least one Training Plan (as described in clause 8) during the Competition Period.

6. By promoting this Competition to Participants, the Retail Partner agrees to be bound by these Terms and ensure the Participants are also bound.

How to Enter
7. From 01/07/2024, the Promoter will announce the Competition through:
a) Promotional materials displayed at the Retail Partner’s in-store location.

8. To enter this Competition (Entry), Participants must, during the Competition Period, signed up to the Canon Advantages Program successfully and completed at least one Training Plan in the Retail Partner’s Canon Advantage Channel.

9. By submitting an Entry, Participants consent to receiving marketing communications and information from Promoter regarding the latest offers and promotions of Canon products and services. Participants may opt out of communications at any time.

Judging
10. This Competition is a game of chance. The Prize will be awarded to 10 randomly selected Entries via a draw (Winner).

11. The Promoter's decision is final, and no correspondence will be entered into.

12. No responsibility is accepted for any Entry that is late, lost or misdirected, or if a Winner does not claim their Prize in accordance with these Terms.

Prize
13. The Winner of the Competition will receive a $100 Digital Visa Gift Card (Digital Gift Card).

14. The total Prize pool is valued at $1000.

15. The Digital Gift Card must be activated within 6 months of receipt and will be valid for a period of 12 months from the date of production.
a. After this period, the Digital Gift Card will no longer be valid. Participants have no right to receive a refund of any unused value remaining and that unused value will become iGoDirect’s property immediately following the expiry date unless it elects otherwise.
b. The Digital Gift Card is not transferable or redeemable for cash.

16. The Promoter will not be responsible for any Digital Gift Card that is lost or stolen.

17. Promoter has the right to replace the Digital Gift Card with another item of similar value in their absolute discretion if for any reason the Digital Gift Card is not available.

Claiming the Prize
18. A draw will take place at 3pm AEST on 12/12/2024 at the head office of the Promoter at Building A The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority. The first 10 valid Entries drawn will be the Winners.

19. The Winners will be notified within seven (7) days of the prize draw date.

20. The Winners will be contacted by their local Canon field representatives. Canon field representatives will obtain the email addresses from the Winners for Digital Gift Cards’ processing.
a. The Promoter will
a. send the Digital Gift Card to the email address provided to Canon field representatives.
b. Participants must follow the steps detailed within the email to use the Digital Gift Card. Use of the Digital Gift Card requires Participants to download an app and is subject to Visa’s terms and conditions at https://truerewards.com.au/visa-giftcard-terms.

21. The Winners must follow the instructions in the email to claim their Digital Gift Card.

22. The name of the Winners will be given to the Retail Partner’s head office and the Winners consents to the Retail Partner and Promotor publishing their name in an announcement.

23. The Winners must provide their names and email addresses to claim the Prizes to Canon field team representative via written confirmation.

24. If the Winner:
a. does not claim their Digital Gift Card according to the instructions specified in the Promoter’s email (including by not providing a correct email address for the Prize to be delivered to by the stated due date); or
b. cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Digital Gift Card in its entirety and the Promoter will choose an alternate Winner at random via a draw from the rest of the Entries at their sole discretion.

25. If a Winner forfeits the Digital Gift Card, a secondary draw may take place at 3pm AEST on 19/12/2024 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.

26. The Digital Gift Card or any unused portion of the Digital Gift Card is not exchangeable for cash and is not transferrable. The Promoter will not compensate the Winners in any way for a Digital Gift Card that has not been claimed within the time limits and in accordance with the instructions given to the Winners.

27. The Digital Gift Card will be valid for a period of 12 months from the date of issue. After this period, the Prize will no longer be valid. Winners have no right to receive a refund for any unused value remaining after the expiry date.

Participant’s Warranties and Indemnity
28. The Promoter is not liable for any costs and claims in connection with a failure by itself to comply with these Terms.

29. Each Participant agrees that they are fully responsible for each Entry they submit. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.

30. This Competition is in no way endorsed, sponsored or affiliated with Myagi Software. The Promoter is not liable for any costs and claims arising in connection with a failure by Myagi Software service provider to comply with these Terms, or otherwise arising in connection with this Competition.

31. Participants agree the Prize may be regarded as benefits inkind and be liable to taxes, including fringe benefits tax. Participants and their employer are liable for all such taxes. The Promoter recommends Participants and the Retail Partner obtain independent tax advice in this regard.

32. By accepting these Terms, the Participants confirm they have reviewed and accepted the policies, terms and conditions of Myagi software.

Conditions that may Invalidate Entries, Participants or the Competition
33. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.

34. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
a. to disqualify any Participant; or
b. modify, suspend, terminate, or cancel the Competition as appropriate.

35. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.

36. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Privacy
37. The Promoter collects personal information in order to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.

38. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.com.au/Privacy-Policy).

Liability
39. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Digital Gift Card’s value to that stated in these terms; (e) any tax liability incurred by a Participant; or (f) use of the Digital Gift Card.

General
41. These Terms may change, and the Promoter will inform Participants of any changes as soon as reasonably possible.

42. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.

43. All money amounts in these Terms are in Australian Dollars inclusive of GST.

44. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.

45. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.
